Practice limited to state and federal

post-conviction work, criminal appeals,

and revocation of supervision  

 

     

       

 

    Henak Law Office, S.C. is based on the principle that it is usually best to focus on what one does well.  Robert Henak has focused his practice on the defense of criminal cases since September, 1983, and has limited his practice almost exclusively to federal sentencing, state and federal post-conviction work, and criminal appeals since 1987.

 

    Mr. Henak has represented people charged with crimes on post-conviction motions throughout Wisconsin and on appeal in the Wisconsin Court of Appeals and Supreme Court, as well as in a number of federal district courts and circuit courts of appeals.  To date, his cases have resulted in nearly 100  published decisions and a much larger number of unpublished decisions.

 

    Mr. Henak also is actively involved in improving the criminal justice system.  He is a long-time member of the Board of Directors of  the Wisconsin Association of Criminal Defense Lawyers and remains Chair of WACDL's amicus committee.  He has authored amicus briefs on behalf of both WACDL and the Wisconsin Civil Liberties Union Foundation.  Mr. Henak also has been an ad hoc member of the Appellate Practice Committee of the Wisconsin Judicial Council, working on reforms of state rules concerning both presentence investigation reports and petitions for review to the Wisconsin Supreme Court.  He is also co-chair of the Pro Bono Project of the Wisconsin State Bar's Appellate Practice Section.

 

    Mr. Henak spoke on Supervisory Writs in State Criminal Cases at the Milwaukee Bar Association's 2008 program on Appeals from Start to Finish.  He previously spoke on the Duty of Competency for Appellate Lawyers at the 2004 Wisconsin State Bar Convention,  Remedies after Direct Appeal at the Wisconsin State Public Defender Conference.

 

    Mr. Henak also is unafraid to speak up on important issues.  See his Letter to the Editor of the Wisconsin Law Journal regarding the Seventh Circuit's decision in McReynolds v. United States, in which the Court published a decision affecting thousands of federal prisoners without appointing counsel or even granting briefing on the issue.  See also his letter to the Wisconsin Court of Appeals' Publication Committee regarding misplaced dicta in State ex rel. Santana v. Endicott.

 

    In March, 2005, Mr. Henak was named a Leader in the Law by the Wisconsin Law Journal.  In 2006, he was the subject of a feature article in Wisconsin Super Lawyers magazine.

 

    A more recent newcomer to  Henak Law Office, S.C. is Amelia Bizzaro, whose relatively brief career already has resulted in nine published decisions and an expertise in revocation issues, an area on which she spoke at the 2007 State Public Defender Conference, as well as a prior WACDL seminar.

 

     Also members of the firm are part-time attorneys Ellen Henak and Rebecca Lawnicki.
